AGREEMENT BETWEEN THE USER AND NAUTYGO.COM

1. General

   Welcome to the Nautygo.com website (the "website"). The terms "we," "us," "ours," "our," "Nautygo," and "Nautygo.com" refer to Nautygo.com, a booking platform created by ADSWEBMARKET SAS, located in SAN ANDRES ISLAS (Colombia), a private company incorporated under the laws of Colombia registered with the NIT 900492361-9. You may access our website, or any NautyGO.com mobile or tablet application, or any other Nautygo.com feature or platform (collectively, the "Platform") subject to your acceptance, without modification, of all the terms, conditions, and notices set forth below (collectively, the "Terms"). We recommend that you print a copy of these Terms for future reference. Please read these Terms carefully as they contain important information about limitations of liability. Also, you must read our Privacy Policy, which is incorporated by reference into these Terms and also governs the use of our Platform and the conditions under which we may process any personal information we collect from you or that you provide to us. By accessing or using our Platform, you acknowledge and affirm that you have read and understood these Terms, as well as our Privacy Policy, and agree to be bound by both. If you do not agree to these Terms, do not use or access our Platform, or contact us.

2. Changes to the Terms

   We may occasionally modify these Terms to comply with regulatory requirements or if changes occur in our business practices. Whenever reasonably possible, we will inform you of any substantial changes to these Terms. 3. Access and Use of the Platform

You will not attempt to gain unauthorized access to the Platform, the server on which it is hosted, or any server, computer, or database connected to it. You will not attack the Platform with a denial-of-service attack or a distributed denial-of-service attack. We will report any such violation to the appropriate law enforcement authorities and cooperate with those authorities by disclosing your identity. In the event of such a breach, your right to use the Platform will cease immediately.

4. We Do Not Sell Products

   The Platform is a search engine for nautical experiences that provides users with comparisons of different offers. Nautygo.com does not offer, own, or control any of the services or products that users may access through our Platform. Products and services are owned, controlled, and made available by third parties (the "Providers"), either directly (e.g., a tour) or through a booking facilitator (e.g., an online travel company). Providers are responsible for the Products and all booking contracts. Booking a Product will only be done with the Provider's consent. Your booking will be subject to the Provider's terms and privacy policy, so you must accept and understand those terms. In addition, the terms of service of the service provider, if different or special, will also apply to your booking, so you must accept and understand those terms. Any interaction you have with any Provider through our Platform is at your own risk, and Nautygo.com will not be responsible in any way if any issues arise with your booking.    Nautygo.com hosts content, including prices, images, and other information, obtained from Providers or made available by them ( "Provider Content"), as well as content provided by users, such as comments, ratings, and other information ("User Content," which, together with Provider Content, makes up the "Content"). NautyGO.com assumes no responsibility for the accuracy, quality, completeness, reliability, timeliness, or credibility of the Content, and it has no influence on it. In particular, we do not guarantee that Provider Content, especially the displayed prices, is updated in real-time, or that a specific Product is available. Therefore, the price displayed by a hotel provider may not correspond to the one shown on our Platform. The provider ratings displayed on the Platform are for general guidance only, and we cannot guarantee their accuracy or that of any User Content.

5. Our Booking Engine

   The Nautygo.com service facilitates the booking of a Product with a Provider through our Platform and will be available occasionally at our sole discretion. If you decide to use Nautygo.com (if available), the booking will be made with the Provider listed on the booking page, and your booking information will be sent to the relevant Provider. When you make a booking through Nautygo.com, our Platform will act solely as a user interface, and your booking with the Provider will only be valid if you receive written confirmation within 2 days from the moment the Provider accepts your booking. The contract for the corresponding booking will be concluded between the Provider and you. Nautygo.com is not responsible for the booking or the Product because Nautygo.com is not involved in creating the Product description, defining the price, or any other applicable amounts, or in providing the Products you book. If you have any problems or discrepancies with your booking or the Product, you agree to address and resolve these issues with the Provider, not with us.

6. Use of the Platform

   As a condition for using our Platform, you agree that:

   • You are at least 18 years of age.
   • You have sufficient legal capacity to be bound by a contractual relationship.
   • You will use the Platform in accordance with these Terms.
   • You will use the Platform solely for private purposes to search for legitimate hotel offers.
   • If you use the Platform on behalf of a third party, you will inform them of the Terms that apply to the searches or bookings you have made on their behalf, including all relevant rules and restrictions.
   • All information you provide on our Platform is true, accurate, current, and complete, and if you have an account with Nautygo, you will protect your account information, monitor it, and be fully responsible for the use of your account by yourself or anyone other than you.

   We reserve the right, at our sole discretion, to deny access to our Platform to any person at any time and for any reason, including, among other things, a violation of these Terms.

   The prices offered on the Platform will be displayed in the currency you have selected. If you do not select a currency, the currency corresponding to the top-level domain will be used as the default value. Our currency conversion is provided for information purposes only and may not be up-to-date. The final price may differ depending on the currency used to complete the booking. Therefore, the final amount for your booking may differ from the price displayed on the Platform.

   Depending on your preferences, the Platform may also display certain options of third parties in search results, like other booking platforms. By using the Platform, you agree to the display of these search results based on your preferences. In this case, you will book a Product through our affiliated third-party booking platform, and their terms and conditions will apply to your booking.

9. Disclaimer of Warranties and Limitation of Liability

   Nothing in these Terms shall affect any statutory rights that you cannot contractually agree to alter or waive, and are legally afforded to you. Nothing in these Terms will affect your legal rights as a consumer.

   The Platform is provided "as is" and "as available." We do not guarantee that the Platform will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programs, and platform to access our Platform. You should use your virus protection software.

   We cannot guarantee that access to the Platform or any of its content will always be available or uninterrupted. We may suspend, withdraw, or interrupt the Platform, in whole or in part, without prior notice. We will not be liable to you if, for any reason, our Platform is unavailable at any time or for any period. You are responsible for making all necessary arrangements for you to have access to our Platform. You are also responsible for ensuring that all persons who access our Platform through your internet connection are aware of these Terms and other applicable terms and conditions and that they comply with them.

   The information and content published on our Platform may include inaccuracies or typographical errors. We do not guarantee the accuracy and completeness of the information and content. We are not liable for any inaccuracies or errors, or for any loss or damage caused by or arising from any user's reliance on information obtained from or through the Platform.    To the maximum extent permitted by law, we (together with our directors, employees, and suppliers) expressly exclude any liability, whether in contract, tort (including negligence), or otherwise, for any direct, indirect, or consequential loss, injury, or damage arising from the use of the Platform or any Product booked via the Platform. To the maximum extent permitted by law, we (together with our directors, employees, and suppliers) disclaim all representations and warranties (whether express or implied) including, but not limited to, implied warranties and conditions of satisfactory quality, fitness for a particular purpose, and non-infringement.

   If you make a booking with a Provider through Nautygo.com, the Provider's terms and conditions will apply to your booking, and the Provider may be liable to you for any loss or damage you may incur in connection with your booking.

   The foregoing does not affect any liability that cannot be excluded or limited under applicable law.

   Applicable law requires us to inform you that it is not permitted to book a room at a Property located in a destination where it is illegal. If you make a booking for a room located in a destination where it is illegal to book or stay in a room, you agree to be solely responsible for your decision to book a room at the Property.

10. Intellectual Property Rights

    The copyright and all other (intellectual property) rights of the material on our Platform are owned by Nautygo.com, its Providers, or our licensors. You are not allowed to use or extract any data, including, but not limited to, prices, for commercial purposes. We only grant you a limited, revocable, non-exclusive, non-sublicensable, and non-transferable license to use our Platform solely for your personal use, in accordance with these Terms. Any other use of our Platform or Content is strictly prohibited. You may not reproduce, distribute, display, sell, lease, transmit, create derivative works from, translate, modify, reverse-engineer, disassemble, decompile, or otherwise exploit this Platform or any portion of it unless expressly permitted by us in writing. You will not make fraudulent or speculative reservations or any reservation in anticipation of demand. You will not fake any affiliation with Nautygo.com or any of our Providers. You agree that you will not use any robot, spider, scraper, or other automated means to access our Platform for any purpose without our express written permission. You will not take any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on our infrastructure. You will not copy, reproduce, alter, modify, create derivative works, or publicly display any Content (except for your personal information) from our Platform without our prior written permission.

    You may use information on our Platform regarding the Products intentionally made available by us for downloading from our Platform, provided that you do not remove any trademark, copyright, or other notice from such information.

11. Miscellaneous

    If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Nautygo.com's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

    Nautygo.com reserves the right to amend these Terms at any time and without notice, and it is your responsibility to review these Terms for any changes. Your use of the Platform following any amendment of these Terms will signify your assent to and acceptance of its revised terms.

    Except as provided in a particular notice or agreement, these Terms and the Privacy Policy constitute the entire agreement between you and Nautygo.com with respect to the use of the Platform.
